Über die Hälfte der Lebensversicherungen in Deutschland werden vorzeitig beendet. Eine Kündigung des Vertrages vor Erreichen des vereinbarten Ablauftermins ist für den Versicherungsnehmer mit erheblichen finanziellen Einbußen verbunden, da der Rückkaufswert, den der Versicherer im Stornofall auszahlen muss, geringer ist als der wirkliche Wert (sog. "innerer Wert") der Police.
Diese Lücke zwischen innerem und Rückkaufswert bildet die Grundlage für den Zweitmarkt für Lebensversicherungen.

Die auf diesem Markt agierenden Unternehmen kaufen Policen von Versicherungsnehmern, die den Vertrag anderenfalls stornieren würden und treten entweder als neuer Versicherungsnehmer ein oder erhalten sämtliche Rechte aus dem Vertrag, für den sie im Gegenzug die künftigen Prämien zahlen. Ziel ist es, die renditeoptimierten Policen in größeren Pakten gewinnbringend an Investoren zu verkaufen.

Die Arbeit untersucht im Rahmen einer rechtsvergleichenden Analyse, inwieweit sich die gesetzlichen Regelungen in Deutschland, den USA und Großbritannien voneinander unterscheiden und was mögliche Ursachen dafür sein können. Es wird analysiert, ob und inwieweit ein Verkauf auf dem Zweitmarkt im Vergleich zur Kündigung der Versicherung
vorteilhaft für die beteiligten Parteien ist und wie die Übertragung der Police rechtlich zu gestalten ist, um ein für alle Beteiligten zufrieden stellendes Ergebnis zu erzielen. Dabei wird auch aufgezeigt, ob es bereits nach geltendem Recht eine Rechtspflicht des Versicherers, des Versicherungsvermittlers sowie weiterer Sachwalter gibt, den kündigungswilligen Versicherungsnehmer über den Zweitmarkt für Lebensversicherungen zu informieren.
